Many people who begin their immigration process in Paraguay hear the terms Precarious Residence and Temporary Residence and assume that they are the same document.

However, they are different concepts and each one fulfills a specific function within the migration process.

What is Precarious Residence?

Precarious Residence is a temporary authorization issued by the National Directorate of Migration once the foreigner submits his or her application for residence.

In other words, the Precaria is the document that shows that your residency application is in process.

It does not constitute definitive residence nor does it replace the residence resolution.

Its objective is to allow the applicant to remain legally in Paraguay while Migrations analyzes and resolves their file.

Benefits of Precarious Residence

While the residency application is being processed, Precarious Residence generally allows:

  • Stay legally in Paraguay.
  • Work legally.
  • Study legally.
  • Leave and re-enter the country.
  • Carry out various administrative procedures while the residency is resolved.

The Precaria usually remains in force until Migrations issues a resolution on the application submitted.

What is Temporary Residence?

Temporary Residence is an immigration authorization granted by the National Directorate of Migration to foreigners who wish to legally establish themselves in Paraguay to carry out legal activities within the country.

Currently, Temporary Residence is regulated by Law No. 6984/2022 on Migration.

Benefits of Temporary Residence

Temporary Residence allows:

  • Live legally in Paraguay.
  • Work legally.
  • Study legally.
  • Open companies and develop commercial activities.
  • Obtain the Paraguayan Identity Card.
  • Enter and leave the country freely.

Main Differences Between Precarious and Temporary Residence

Precarious Residence

How to Obtain Temporary Residence?

Step 1: Gather Documentation

In most cases it is required:

  • Valid passport.
  • Apostille birth certificate.
  • Apostilled criminal record certificate.
  • Marriage or divorce certificate (if applicable).
  • Documentation that demonstrates legal residence in a third country when applicable.

Step 2: Translate the Documents

Documents issued in languages ​​other than Spanish generally must be translated in accordance with Paraguayan legal requirements.

Documents issued in Portuguese by Brazil are usually exempt from translation.

Step 3: Enter Paraguay

Once in Paraguay, the applicant must keep:

  • The entry seal.

Step 4: Obtain Local Certificates

Typically required:

  • Interpol certificateMandatory for those over 14 years old.
  • Background Certificate for ForeignersIssued by the National Police.

The application is submitted in person to the National Migration Directorate.

At this time, all the required documentation is delivered and the immigration file is formalized.

Step 6: Obtain Precarious Residence

Once the application is submitted, Migrations issues the Precarious Residence.

This document allows the applicant to remain legally in Paraguay while waiting for the resolution of their file.

Step 7: Approval of Temporary Residence

After reviewing the file, Migrations issues the corresponding resolution.

Currently, processing time is typically approximately 90 days from submission of the application, although it may vary on a case-by-case basis.

Step 8: Obtain the Paraguayan ID

Once the residence is approved, the foreigner can request the Paraguayan Identity Card from the Identification Department of the National Police.

What is the Next Step After Temporary Residence?

Temporary Residence constitutes the previous step to obtain Permanent Residence.

Generally, the application for Permanent Residence can be submitted before the expiration of Temporary Residence, as long as the requirements established by current immigration legislation are met.
